Terms and Conditions for Successional

1. Subscription & Payment Terms

Successional is offered on a paid subscription basis (e.g., monthly or annual plans).

• •Billing: Subscription fees are billed in advance on a recurring basis according to your chosen billing cycle. Payments are processed securely via our third-party payment provider.
• •Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless cancelled prior to the renewal date.
• •Cancellation: You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation will take effect at the end of your current paid billing period, and you will retain access until that date.
• •Right of Withdrawal (UK Consumer Regulations): If you are a UK consumer, you have a statutory right to cancel your subscription within 14 days of signing up ("cooling-off period"). However, by immediately accessing or generating AI schemes upon subscribing, you acknowledge and agree to waive this 14-day cooling-off period once performance of the digital service has begun.

2. Fair Use Policy & AI Generation Limits

To ensure platform performance, prevent system abuse, and manage computational costs, Successional enforces a Fair Use Policy on AI-curated scheme generations.

• •Generation Quotas: Depending on your subscription tier, your account is subject to a maximum limit of AI scheme generations per billing cycle (50 generations monthly).
• •Automated & Excessive Usage: The Service is intended for individual human use. You may not use automated scripts, bots, scrapers, or programmatic tools to trigger generations or extract data.
• •Rate Limiting & Restrictions: We reserve the right to temporarily throttle, cap, or suspend your ability to generate new schemes if your usage unreasonably exceeds normal individual usage patterns or breaches your tier's limits.
• •No Unused Rollover: Unused generation allowances do not roll over into subsequent billing cycles unless explicitly stated in your plan.

3. Horticultural & AI Disclaimer

All planting schemes, seasonal schedules, plant lists, and garden layouts generated by Successional are for conceptual and informational purposes.

• •No Outcome Guarantees: Plant growth, survival, and visual results depend on unpredictable environmental variables, including local soil pH, microclimates, weather extremes, pest presence, watering, and care. Successional does not guarantee specific biological or aesthetic outcomes.
• •Not Professional Advice: Successional does not provide certified landscape architecture or engineering plans. Always check site drainage, soil structure, underground utilities, and planning laws before digging or planting.

4. Account Security & Responsibilities

• •You are responsible for safeguarding your login credentials.
• •You must notify us immediately if you suspect unauthorized access to your account.
• •You may not share your account or subscription credentials with third parties outside your household.

5. Intellectual Property

• •Platform Ownership: Successional, including its software, layout, AI algorithms, graphics, and design, is the property of Successional and its licensors.
• •Generated Content: Subject to your active subscription and compliance with these Terms, we grant you a personal, non-exclusive, non-transferable license to use, save, and print the planting schemes generated for your own non-commercial use.

6. Limitation of Liability & Consumer Rights

• •Statutory Rights: Nothing in these Terms limits or excludes your statutory rights under the UK Consumer Rights Act 2015 or other mandatory UK consumer protection legislation.
• •Exclusion of Consequential Losses: To the maximum extent permitted by UK law, Successional shall not be liable for indirect, consequential, or incidental losses (including loss of plants, landscape costs, or property damage) arising from your use of the Service.
• •Liability Cap: Our aggregate liability for any claims under these Terms shall not exceed the total amount paid by you for the Service in the three (3) months preceding the claim.

7. Service Availability & Modifications

We strive to keep Successional available 24/7, but we do not guarantee uninterrupted uptime. We reserve the right to modify features, adjust generation limits, or update the service to improve performance or comply with regulatory changes.

8. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim, except that if you reside in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
